For an automatic life sentence to be imposed under PCC(S)A 2000 s.109, it was necessary for a defendant to have been actually convicted of another serious offence at the time he committed the second offence. When W was sentenced for the offence of wounding he had not been convicted of the offence of manslaughter and the judge was wrong to impose an automatic life sentence.  Appeal allowed.
