In two joined appeals against confiscation orders, the Court of Appeal reconsidered the circumstances in which confiscation determinations could be postponed beyond the statutory time limit under the Drug Trafficking Act 1994. The court held confiscation orders should normally form part of the ordinary sentencing process but as this case illustrated, this was often impractical owing to insufficient information to enable the court to decide whether the defendant had benefited from drug trafficking, or the amount to be recovered.
