In the exceptional circumstances of this appeal against a murder conviction where the defence relied on an expert report not available at trial, a retrial was ordered as the jury might have taken a different view of the evidence and the trial judge would not have summed up the evidence of the Crown’s pathologist as he did. The appellant was convicted of murder at the subsequent re-trial.
